Per Idaho Code 31-2207 (8):  The Sheriff’s duty is to serve all process and notices in the manner prescribed by law.

Service Information:

Clearwater County Sheriff’s Office handles a variety of civil papers that include tax warrants, protection orders, writs and other orders from the Court, notices, small claims, subpoenas, and summonses.  These papers are processed by the Civil Division in Orofino and served by all Sheriff’s deputies.

Civil Paper Service Fees 

Such as:  Summons & Complaint; Small Claims; Subpoena; Order; Notice

Total:             $40.00   per person, per address

Garnishments:

Bank Levy requires a check in the amount of $5.00, payable to the financial institution to be included as well.

Once the garnishment begins, daily interest rate (if instructed in writ), commission and Interim Return fees are accessed on each check received.

Additional fees may be required for orders, notices, postings, mileage, postage, copies and any other document/s that may be requested to be served or expenses incurred by the Sheriff. 

* “No Found”, “Recalled”, “Unable to Locate after Attempts” will be considered same as “Served” for fee purposes.

Basic Document Requirements 

Letter of Instruction:

  • Date
  • Addressed to the Clearwater County Sheriff
  • Case number
  • Stating who you want served; what type of documents are being served;  where person can be found; any additional information such as age and/or date of birth, telephone number, work place or employer, type of vehicle person drives, etc. that would assist in locating the person.
  • For service at the Idaho Correctional Institution-Orofino, an inmate number and/or date of birth is very helpful.
  • Return address and telephone number, if available, for person requesting service.

A generic Letter of Instruction Form is attached.

Small Claims Letter of Instruction:

  • Date
